Most Bylaws require that the affairs of the Association be conducted “in accordance with Robert’s Rules, or some other form of Parliamentary Procedure…” However, recent amendments to the Nonprofit Corporation Act as well as rulings from the Michigan Court of Appeals cast doubt on the continuing significance and utility of these rules for Associations and their Boards. This class will examine some of these new developments in the law and the extent to which Robert’s Rules may still have value for Associations and Boards.

This session we will address the differences between “service animals” and the American’s with Disabilities Act and Emotional Support Companion Animals (ESCA’s) under the Fair Housing Act as Amended, (FHAA) and Michigan Persons with Disabilities Act and the Michigan Elliott Larsen Civil Rights Act. We will talk about the “interactive process” and what you can and cannot ask and whether or not you have to accept a doctor or other professional’s letter and whether or not you must allow an animal for unrelated reasons.
